When all community and board members know and understand the rules and restrictions, it’s much easier for everyone to be on the same page. Please become familiar with the rules that govern Timberview.

General Appearance

 
 
  1. Homeowners may not landscape; i.e. install, remove, exchange or move plants or landscaping materials in common areas without Board approval. 

  2. Concrete walkways, driveways, pipestems (or shared driveway) and other concrete surfaces with a townhome and visible to the residents of Timberview Cluster must be maintained in a clean and clear (free of newspapers, trash, debris, etc.) condition and in good repair by the townhome owner.

  3. Window blinds shall be installed in all garage windows to enhance exterior appearances, by blocking the direct view of garage interiors. Garage window blinds shall be a light color to match the house trim color, and they should routinely be kept closed. They shall be maintained in good physical appearance, and must be repaired or replaced if they become damaged or bent. 

  4. Garage doors must be kept closed except when working inside of or utilizing materials out of the garage.

  5. Firewood may be stored on common ground in proximity to the property line of the owner’’s home, neatly stacked and uncovered, and with consideration of the impact on the neighbors’ view.

  6. Other than firewood, there is no storage of items on common ground and no unsightly storage of personal property in open back yards. 

  7. Only bird feeders may be attached to trees on common area, 

  8. All outdoor light fixtures including cross bars on lamp posts must be maintained in original and functional condition and must use only clear bulbs. 40 watt “Warm White” bulbs only. Not to exceed 3000 kelvins. ‘Cool White” light bulbs are not permitted in Timberview.

  9. Trash must be put in barrels or closed containers (not bags) to prevent scavenging. Containers must not be placed for collection before twilight on the day preceding collection. Emptied containers must be returned to, and stored in garages on the day of trash collection. 

Conduct and Usage

All residents, visitors and guests must minimize and limit the generation of noise and its impact on residents of Timberview Cluster.

    1. Persistent noise (barking, etc.) from animals is not permitted. 

    2. No construction, repairs or operation of machinery which generates excessive sound is permitted before 7:30 am and after 5:30 pm on weekdays, or before 9:00 am or after 5:30 pm on weekends and holidays. No operation of tools and machinery which generates excessive noise may be regularly or routinely used within the Timberview Cluster, 

    3. No loud noise generated by motor vehicles, or loud sounds from radios, stereos, etc. is permitted. 

For Sale Signs

  1. Only one real estate sign per property is permitted in front of each home. In addition, one real estate sign per property may be posted at the community entrance at North Village Road. 

  2. Common property may not be used for yard sales without prior approval by the Board of Directors. 

Leasing

The following shall apply to all leased properties:

  1. No property can be leased or subleased for a period less than six (6) months

  2. Owners shall be responsible for ensuring that renters comply with all HOA Rules & Regulations.

  3. The full names of the renters, and appropriate contact information, shall be provided to the Management Agent for the purpose of providing HOA correspondence; emergency, informational, social notices,etc.

  4. A copy of each lease must be forwarded to Management Agent of Board of Directors within 15 days of ratification of the lease. In lieu of providing a copy of the lease, the homeowner may provide a statement signed by the owner and renter(s), with appropriate renter contact information, certifying that the property is not rented less than six months, and that the renter(s) will comply with all HOA Rules & Regulations. 

Pets

While pets are welcome in Timberview Cluster Association, there are a few rules and requirements. Please become familiar with the following rules and use common sense.

  1. Curb your pet. No one wants to see, smell or accidentally step in the “gift” your dog left on the grassy common area. So, if and when a dog needs to go, it needs to be properly disposed of, preferably in a pet waste disposal can. Not only will this keep our community looking better, but it will help keep groundwater clean and help prevent the spread of fecal-borne diseases. All residents and guests must comply with the leash and “pooper scooper” laws of Fairfax County.

  2. Pets shall not be tied outdoors and left unattended in unfenced areas. 

Vehicles and Parking

  1. Each Timberview home has a two-car garage and a driveway that accommodates a minimum of two cars. All resident vehicles are to be parked in a driveway and/or garage. 

  2. Vehicles shall not be parked on common area or any part of the homeowner’s lawn or to impede sidewalk access. 

  3. There are five designated visitor parking areas which are intended for Timberview guests and contractors.

  4. . They are not intended for regular or overnight parking of resident vehicles, unless prior notification has been given to the management company. 

  5. The 5 visitor car parking areas are restricted to use by visitors, contractors and emergency vehicles. They can be used temporarily by residents only as detailed below.

    ACCEPTABLE USE OF VISITORS’ CAR SPACES BY RESIDENTS:

    DAYTIME: 7AM to 6PM

    If there is a contractor or service vehicle that prevents a resident from using their driveway, or work is being done on the house, e.g. painting or outside repairs, parking is permitted in the visitor car park from 7am until 6pm This can be for a period of up to 4 consecutive days a month after which an extension approval is needed from the Timberview property management company. You can obtain an extension by contacting the property management with the reason for the request. If authorized, you need to display the authorization notice in your car window or on the dashboard to avoid towing.

    OVERNIGHT: 6PM to7AM

    Overnight parking of resident’s cars in the visitors’ car parks is prohibited without the specific approval of the Timberview property management company. Approval can be obtained by notifying the property management company in writing of the reason to use the visitors' spaces and the authorization notice needs to be displayed in your car window or on the dashboard to avoid towing. 

    There may be occasions where a resident needs to utilize a visitor’s car space overnight and it is not possible to get pre-authorization, e.g. it is an unforeseen situation or after-business hours and this is understood but if more than one night is needed, authorization is needed from the property management company.

  6. There shall be no parking in the pipe stems (or shared driveways). Cars that park on stems are subject to towing at the owner’s expense with no sticker and no advance notice.

  7. Cars that violate the visitor car park rules will have a green violation sticker placed on their window to be towed at the owner’s expense with no advance notice. If your car is towed, contact the property management company to find out how to recover from the towing company that has been engaged.

  8. Fire lanes are designated throughout Timberview by the use of yellow traffic paint on the curbs, and there shall be no parking in the fire lanes at any time. 

  9. Abandoned or derelict vehicles, i.e., vehicles with expired tags, expired inspection stickers, expired county tax decals for cars that have not been moved in two (2) weeks from common property will be towed at the owner’s risk and expense

  10. No commercial vehicles, i.e., oversized vehicles or vehicles with ladders, etc, extending beyond the edge of the vehicle will be regularly parked on common property. Commercial vehicles are further defined as:

    1. Any vehicle in which the drivers is ordinarily hired for transport, including, but not limited to, taxis, limousines, buses; or

    2. Any vehicle with uncovered exterior logos, signs, letters, numbers, advertising, or irregular and distinct coloring which created the appearance of a commercial vehicle; or

    3. Any unmarked vehicle with commercial paraphernalia or equipment attached, strapped, or affixed to the exterior of the vehicle, including, but not limited to storage containers, racks, ladders, or pipes; or

    4. Any unmarked vehicle with an excessive amount of commercial equipment or supplies within the interior of the vehicle which is in the obvious plain view from another parking space or from the sidewalk, including, but not limited to, pesticide, paint buckets, propane tanks, cabling, uncovered or unsecured tools or supplies; or

    5. Any unmarked vehicle, which because of its height, length, shape, or weight, is not a conventional passenger car and is more suited for a commercial purpose; or

    6. Any van designed for the transport of furniture, goods, equipment, animals, or scheduled transport; or

    7. Any vehicle with commercial tags; or

    8. Any private or public school or church buses

The strict prohibition against commercial vehicles shall not apply if the resident covers the commercial vehicle (or the portion of the vehicle which has commercial vehicle characteristics) at all times while parked in the community in the vehicle is then indistinguishable from a conventional passenger vehicle under cover; however, those commercial vehicles, which because of their irregular height, length, shape, weight, or exterior attachments, cannot be made to look indistinguishable from a conventional passenger vehicle under cover shall still be prohibited, regardless of whether or not the vehicle is covered. Police cars or other cars, which are owned by or contain the logo of a County, Federal and/or state emergency service provider, shall not be considered a commercial vehicle under this definition. 

  1. No maintenance of cars or vehicles is permitted on common property except for minor emergency repairs such as jump starting, changing a tire, etc.

  2. Recreational vehicles, boats, trailers or campers shall not be stored outside within the Timberview Cluster.
